You have 20 working days from the date of dismissal to file a claim. Before filing in court, a mandatory conciliation hearing (acto de conciliación) must take place — this step is required by law (article 63 of the Labour Procedure Act). Missing the 20-day deadline means losing the right to claim.

For unfair dismissal (despido improcedente), the employer must pay 33 days’ salary per year worked, capped at 24 months’ pay (article 56 of the Workers’ Statute). For contracts signed before 12 February 2012, the rate for the earlier period is 45 days per year, capped at 42 months.
